Roger Wilco Imagery — Terms of Use
DRAFT v0.1 — 25 October 2026 — not yet in force. Requires legal review before publication. Items marked DECISION need Kevin's call.
Effective date: DECISION: set on publication
These Terms govern your use of Roger Wilco Imagery ("RWI", "we", "us"), a project of Prime Rogue Inc., Calgary, Alberta, Canada. They cover the RWI website (currently rogerwilcomedia.online), SITREPs, the Wilco Watch / DOGINT series, alerts, API access, data feeds, imagery products and any other output we publish or deliver (together, the "Services").
By using the Services you agree to these Terms. If you are using them on behalf of an organization, you confirm you are authorized to bind it.
1. Our commitment
RWI is free for journalists and students, for non-commercial use. It always will be.
Findings we judge to be in the public interest are published openly to everyone. No licence holder gets control over whether the public learns something.
2. Definitions
- RWI Materials — the value-added work we create: SITREPs, analysis, annotations, counts, flags (including dark-ship and change flags), baselines, trend lines, alerts, maps, processed or annotated imagery, provenance manifests and the RWI site content. RWI Materials do not include Code or Third-Party Data.
- Code — software published in RWI repositories. Code is licensed separately under the MIT License (see section 3).
- Third-Party Data — data we draw on from other providers, including Copernicus Sentinel, NASA (e.g. VIIRS Black Marble), USGS/Landsat, OpenStreetMap, ADS-B and AIS sources, and any commercial imagery. It remains under its owners' licences (see section 3).
- Editorial Use — researching, verifying, reporting, writing, producing, publishing or broadcasting journalism, commentary or documentary work.
- Academic Use — coursework, theses and dissertations, academic research, student publications, teaching, and academic conference presentations.
- Commercial Use — any use described in section 6, whether or not the person is also a journalist or student.
- Journalist — a person who regularly gathers and publishes news or public-interest information, whether on staff, freelance or independent, and who can show that work as described in section 5.
- Student — a person currently enrolled at a recognized post-secondary or secondary institution.
3. What licence covers what
| Component | Licence |
|---|---|
| Code | MIT License (see LICENSE) |
| RWI Materials | These Terms |
| Third-Party Data | The original provider's licence |
Third-Party Data notes: - Copernicus Sentinel data: free, including commercial use, with attribution ("Contains modified Copernicus Sentinel data [year]"). - NASA and USGS data: generally public domain; we credit the source. - OpenStreetMap and adsb.lol ADS-B data: Open Database Licence (ODbL). Any database we derive from them is made available under ODbL terms, and nothing in these Terms restricts rights ODbL gives you. Our non-commercial conditions apply to RWI Materials built on top, not to those derived databases. - AIS data: subject to the provider's terms. DECISION: confirm aisstream.io redistribution terms before offering AIS-derived feeds. - Commercial imagery (if added later): may carry stricter redistribution limits, which will be stated on the relevant product.
If a Third-Party Data licence gives you more rights than these Terms, that licence governs for that data.
4. Public access (everyone)
Anyone may, free of charge: - view publicly posted RWI Materials; - link to and share public pages; - quote and reproduce reasonable excerpts for news reporting, criticism, review, commentary, research or education, with attribution (section 9). This is consistent with fair dealing under Canada's Copyright Act, and nothing in these Terms narrows your fair dealing rights.
5. Free Journalist and Student Licence
5.1 Grant
If you are a verified Journalist or Student, we grant you a free, personal, non-exclusive, non-transferable, revocable licence to access and use RWI Materials for Editorial Use or Academic Use, including any features, data and access levels we make available to the public or to registered users.
5.2 What this includes
- Using RWI Materials to report, verify and publish your work, including in for-profit outlets and in freelance work you are paid for. Getting paid for your journalism is not Commercial Use.
- Reproducing RWI imagery, charts and findings within a published story, with attribution.
- Normal syndication of your published story by your outlet.
- For students: using RWI Materials in coursework, theses, student media and academic presentations, and publishing academic work that cites them.
5.3 Conditions
- Use is for your own Editorial or Academic Use. Your account, API key and access are personal and may not be shared.
- You must attribute RWI as described in section 9.
- You may not alter imagery or findings in a way that misrepresents them, or present altered material as RWI's (see section 11).
- You may not use the free licence for anything listed in section 6.
5.4 Verification
We will ask for one or more of the following: - Journalists: a press card; membership in a recognized journalism association (e.g. CAJ, FPJQ, or international equivalents); an email address at a news organization; or, for freelancers and independents, links to recently published work. - Students: an institutional email address or proof of current enrolment.
Free licences are reviewed annually. We may decline or revoke verification at our discretion, including where use appears to fall outside this section.
6. Commercial Use (requires a commercial licence)
Unless you hold a separate written commercial licence from Prime Rogue Inc., you may not: 1. sell, resell, sublicense, rent or redistribute RWI Materials, raw outputs, feeds, bulk imagery or archives; 2. republish RWI Materials in bulk or systematically, or mirror the RWI site or feeds; 3. incorporate RWI Materials into a product, service, platform, dashboard, database or tool offered to others; 4. use RWI Materials to train, fine-tune or evaluate machine-learning models, except for non-commercial Academic Use; 5. use RWI Materials in paid consulting, client deliverables, corporate intelligence, due diligence, insurance underwriting, trading, risk assessment or security services — even if you are also a journalist or student; 6. use RWI Materials in advertising, marketing or promotional material; 7. provide institutional access, meaning use of RWI feeds, API or tooling across a newsroom, company, agency or other organization as shared infrastructure, rather than by individual verified Journalists or Students; 8. scrape, crawl or bulk-download the Services, or exceed published rate limits.
Individual reporters at an outlet remain free under section 5. The outlet needs a commercial licence only if it wants RWI as organizational infrastructure (item 7).
Commercial licences are available. Contact: DECISION: contact address.
7. Editorial independence
- Restricted parties. We do not license RWI Materials, accept funding, or provide custom monitoring or analysis to:
- armed forces and defence departments of any country, including the Department of National Defence and the Canadian Armed Forces, and military alliances such as NATO;
- intelligence and security agencies of any country;
- police and law-enforcement bodies, for surveillance or intelligence purposes;
- defence contractors, and private military or security companies;
- political parties, candidates and election campaigns;
- the Government of Israel, the Government of the Russian Federation and the Government of the Republic of Belarus, including their ministries, departments, agencies and other state bodies, and entities they own or control;
- persons or entities with whom dealings are prohibited under Canadian sanctions law (and only to the extent Canadian law prohibits them; foreign sanctions regimes do not apply).
- Case by case, with disclosure. Other public bodies (for example non-defence departments, Crown corporations and international organizations) and organizations with substantial defence-industry funding are considered individually and disclosed under the transparency commitment below.
- No workarounds. A commercial licensee may not act on behalf of, resell to, or share RWI Materials with a restricted party. Commercial licensees confirm who the end user is before a licence is granted, and a breach ends the licence immediately.
- Transparency. We publish, at least once a year, the categories of commercial licensees and funders we work with.
- No customer can buy suppression, delay or alteration of a finding.
- No licensing arrangement gives anyone the right to delay public release of a finding we judge to be in the public interest.
- Custom watchlist clients do not acquire exclusive rights over the sites they fund; we may publish public-interest findings from them.
8. Accounts, API keys and rate limits
- You must give accurate information when you register and keep your credentials secure.
- API keys are personal (free licence) or tied to the licensed organization (commercial licence).
- We may set rate limits. Usage well beyond what Editorial or Academic Use plausibly needs may lead us to ask about your use, require a commercial licence, or suspend access.
9. Attribution
When you use RWI Materials, credit them as:
Source: Roger Wilco Imagery / Prime Rogue Inc. — with the SITREP number or product name and a link where the format allows.
Where imagery includes Third-Party Data, also keep the required provider credit (e.g. "Contains modified Copernicus Sentinel data 2026").
Short forms ("Roger Wilco Imagery", "RWI / Prime Rogue") are fine on broadcast, in captions and on social media.
10. Acceptable use (all users)
You may not use the Services to: - identify, locate, track, target or harass individual people, including service members, their families or private vessel and aircraft owners; - plan or facilitate violence, sabotage or any unlawful act; - break any law, including sanctions and export-control laws; - interfere with, probe or overload the Services, or bypass access controls; - impersonate RWI or Prime Rogue Inc.
11. Integrity and provenance
RWI publishes SHA-256 manifests and timestamp proofs (OpenTimestamps and, where enabled, a blockchain anchor) for its outputs. You may not present altered, cropped-to-mislead or fabricated material as RWI's. Accurate cropping, resizing and annotation clearly marked as your own are fine.
12. Accuracy and no warranty
RWI Materials are open-source analysis based on satellite imagery and other public data. They can be incomplete, delayed, wrong, or affected by cloud, resolution, sensor and data-source limits.
- RWI Materials are provided "as is" and "as available", without warranties of any kind, to the extent permitted by law.
- They are not suitable for navigation, safety-of-life, targeting or operational military decisions. This specifically includes the GNSS interference map, navigation warnings and NOTAM layers. Always use official sources for navigation and safety.
- You are responsible for independently verifying anything you publish or rely on.
13. Limitation of liability
To the extent permitted by law, Prime Rogue Inc. and its directors, staff and contributors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim and CAD $100.
Some jurisdictions, including Quebec, do not allow certain exclusions or limits. Where that applies, these limits apply only to the extent the law allows.
14. Indemnity
If you use the Services in breach of these Terms or the law, you agree to indemnify Prime Rogue Inc. against resulting third-party claims, losses and reasonable legal costs.
15. Suspension and termination
We may suspend or end your access, including a free licence, if you breach these Terms or if we reasonably believe your use falls outside the licence you hold. Sections 3, 6, 10–14 and 17 survive termination. Material you published in compliance with these Terms while your licence was active may stay published.
16. Privacy
Our handling of personal information is described in the RWI Privacy Policy. DECISION: privacy policy to be written; RWI collects registration and verification data, so it is needed before accounts launch.
17. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. The courts of Alberta, sitting in Calgary, have exclusive jurisdiction, except where consumer-protection law gives you the right to sue elsewhere.
18. Changes
We may update these Terms. We will post the new version with a new effective date and, for material changes, notify registered users at least 30 days before they take effect. Continued use after that date means you accept the updated Terms.
TBD: French version. If a French version is published, both versions are equally authoritative.
